Artist Terms

Who can submit

This is an agreement between you and MaskedWaffle Ltd, a private limited company registered in England and Wales under company number 17507750, with its registered office at 128 City Road, London, United Kingdom, EC1V 2NX ("MaskedWaffle", "we" or "us"). You must be 18 or over. Do not submit someone else's work unless you have their written authority to grant every permission below. Each artwork is governed by the version of these terms you accept when you submit it.

Your artwork stays yours

You keep your copyright and all other rights in your artwork and can continue to display, sell and license it elsewhere. These terms grant a non-exclusive licence; they do not transfer ownership.

What you confirm

When you submit artwork, you warrant that:

• you created it and own or control all rights needed for the uses in these terms;
• no generative AI was used at any stage to create, generate, edit or assist with any part of it;
• it does not copy or closely imitate another creator's work, infringe intellectual property, misuse a person's image or private information, or break the law;
• you have any permission needed for identifiable people, third-party material, characters, brands or other protected content it contains; and
• your profile information is accurate and does not impersonate or mislead anyone.

Tell us promptly if any of these stop being true. We may reject or remove material that is unlawful, deceptive, hateful, sexually explicit, unsafe, unsuitable for the game, or likely to cause a rights or platform-policy problem.

The game licence

You grant MaskedWaffle a worldwide, royalty-free, non-exclusive licence to store, review, reproduce, adapt, display, communicate and distribute the artwork and your artist profile material as part of Trading Art Shop, including its builds, updates, ports, backups and player-facing services, and to sell and distribute the game commercially. The licence continues until it ends under the removal section below.

We may let developers, publishers, contractors, distributors, storefronts and platform operators use the material only as needed to make, test, distribute, operate and support the game, and may transfer the licence only together with Trading Art Shop or the part of the business that runs it. The licence does not let us sell your artwork on its own, use it for unrelated merchandise or NFTs, or use it to train a generative AI model.

Card treatment and credit

We may resize, crop, compress, convert or colour-process the artwork and combine it with card frames, text, effects and game interfaces. We will not intentionally make changes that are derogatory or damaging to your reputation. To the extent permitted by law, you consent to these agreed treatments and will not object to them solely because they change the artwork's format or presentation.

We will make reasonable efforts to credit the artist name in your profile where the format supports it, and may show your artist name, logo, country and selected social handles to players. Credit cannot be guaranteed in every screenshot, clip or listing.

Promotion is a separate choice

Promotion is optional. If you tick the promotional-use box, you also allow us to use that artwork, its card and your artist credit in trailers, store pages, press material, events and social posts for Trading Art Shop. You can withdraw this at any time by emailing privacy@maskedwaffle.com or deleting your account; we will not use the work in new promotional material after that, but material already published may remain. Withdrawing from promotion does not withdraw the game licence.

Review, selection and payment

Submission does not guarantee acceptance, inclusion in a release, promotion or paid work. We may accept, decline or remove artwork for quality, rights, legal, safety, platform or project-fit reasons. Edits or a replacement file may return a card to review; a declined card returns its submission slot and leaves any Evolution until resubmitted and accepted. Artist names, social handles and logos are reviewed before they appear in the game.

Patreon tiers provide only the submission formats, allowances and benefits described for the relevant cycle. Unless a separate written agreement signed by MaskedWaffle says otherwise, no fee, royalty, revenue share or other payment is owed for submitting artwork or for its use under this licence. Submitting artwork, being credited or holding a membership gives you no ownership, equity or other interest in MaskedWaffle or Trading Art Shop and creates no employment, partnership or agency relationship.

Removing artwork and rights concerns

You can delete a submission or your account in the portal, or email us. Deletion removes your live profile and submissions from the website and queues released cards and artist details for removal from the next game update. If the artwork has not entered a released or committed build, the licence ends once we have completed reasonable technical and record-keeping steps. If it has, we stop including it in later releases within a reasonable period, but builds already distributed are not recalled and the licence continues only as needed for those builds, backups, release records and legal claims.

If a third party raises a credible rights concern, we may hide or remove the material while we review it, and will normally hear from both sides before a final decision unless urgent action is needed. You are responsible for reasonable direct losses and costs caused by a material breach of your confirmations above, except to the extent caused by our own conduct; we will give you reasonable notice of any claim and will not settle on your behalf without consulting you. Nothing here limits responsibility that cannot lawfully be limited.

Law, changes and contact

These terms are governed by the law of England and Wales; consumers keep any mandatory protections of the law where they live. If one term cannot be enforced, the rest still apply. Changes apply to future submissions unless you accept them for existing work or the law requires them.
